1. About the Service

Somewhere FM is a free, AI-operated internet radio station available to listeners worldwide. Our service includes:

• —Live and scheduled internet radio streaming
• —A web-based audio player
• —A listener message submission form
• —Optional financial support via Ko-fi

2. Acceptance of Terms

By accessing Somewhere FM, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use of the service.

3. Eligibility and Age Policy

Listening

Somewhere FM's radio streaming is open to listeners of all ages. We are a general-audience service and do not produce content specifically directed at children.

Message Submission

Anyone may submit a listener message. Users under 18 years of age should do so under parental or guardian supervision.

Financial Transactions (Ko-fi Support / Future Purchases)

Users under 18 years of age must have parental or guardian consent before making any financial transaction, including but not limited to:

• —Supporting us via Ko-fi
• —Purchasing merchandise (when available)
• —Any other paid features introduced in the future

We are not responsible for unauthorized transactions made by minors without parental consent.

4. Listener Messages

By submitting a message to Somewhere FM, you grant smart infini a worldwide, non-exclusive, royalty-free license to use, reproduce, edit, adapt, translate, and publicly perform your message, in whole or in part, together with any name or handle you provide, in connection with the Service. This includes:

• (a)reading your message on air during broadcasts;
• (b)including your message in recorded archives of broadcasts; and
• (c)including your message in short-form clips and other promotional materials published on third-party platforms (such as YouTube, TikTok, and Instagram).

You represent that any message you submit is your own, is lawful, and does not infringe the rights of any third party.

If you do not want your message to be used in archives or clips, please say so clearly in your message and we will make reasonable efforts to honor your request. Please note that once a message has been broadcast or published, complete removal of all copies — including copies made or shared by third parties — may no longer be possible. For information about how to request deletion of stored personal data, see our Privacy Policy.

Submitted messages must not contain:

• —Hate speech, discrimination, or harassment of any kind
• —Explicit sexual content
• —Content that promotes violence or illegal activity
• —Spam or commercial solicitation
• —Personal information of third parties without their consent

We reserve the right to discard messages that violate these guidelines without notice.

5. Intellectual Property

Our Content

All content produced or distributed by Somewhere FM — including AI-generated speech, music programming, DJ personas, station branding, and associated materials — is owned by or licensed to smart infini, or is otherwise operated and controlled by smart infini as the operator of the Service.

Regardless of the copyright status of any individual piece of content, you agree, as a condition of using the Service, not to copy, record, reproduce, redistribute, sell, or create derivative works from any content obtained through the Service without the prior written permission of smart infini, except as expressly permitted by these Terms or required by applicable law.

Music

Music broadcast on Somewhere FM is licensed through Flow Music (commercial plan) and other properly licensed sources. We do not claim ownership of third-party music content.

User-Submitted Messages

By submitting a message, you grant Somewhere FM a non-exclusive, royalty-free license to use, reproduce, and broadcast the content of your message as part of our radio programming.

6. Copyright Complaints

Somewhere FM broadcasts speech and music generated with AI tools under commercial licenses. We take third-party rights seriously. If you believe that any content broadcast or published by Somewhere FM infringes a copyright or other right that you own or control, please contact us at [email protected] with:

• 1.identification of the work you believe has been infringed;
• 2.identification of the Somewhere FM content at issue, with enough detail for us to locate it (for example: date, approximate time, and program name);
• 3.your name and contact information; and
• 4.a statement that you believe in good faith that the use is not authorized by the rights holder or by law.

We will review all complaints promptly. Where appropriate, we may suspend broadcasting of the content at issue while we investigate, and we will inform you of the outcome. You do not need legal representation to submit a complaint.

7. Prohibited Conduct

When using Somewhere FM, you agree not to:

• —Attempt to disrupt, overload, or interfere with the service or its infrastructure
• —Use automated tools to scrape, crawl, or collect data from our site without permission
• —Impersonate any person, DJ character, or entity associated with Somewhere FM
• —Use the service for any unlawful purpose
• —Attempt to gain unauthorized access to any part of our systems
• —Record, capture, or reproduce any audio broadcast from Somewhere FM in any format without prior written permission from smart infini
• —Re-distribute, re-broadcast, or publish any recorded content from Somewhere FM on any platform or service
• —Monetize or profit from any content recorded or captured from Somewhere FM without prior written permission from smart infini

8. Ko-fi and Financial Support

Contributions made through Ko-fi are voluntary and non-refundable. They represent support for the creator and do not constitute a purchase of goods or services unless explicitly stated otherwise.

Ko-fi transactions are governed by Ko-fi's own Terms of Service and Privacy Policy. We are not responsible for any issues arising from Ko-fi's platform.

9. Disclaimer of Warranties

Somewhere FM is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• —Uninterrupted or error-free service
• —Accuracy of any information provided on air or on the website
• —That the service will meet your expectations

10. Limitation of Liability

To the fullest extent permitted by applicable law, smart infini shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, Somewhere FM.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice. We will make reasonable efforts to inform users of significant changes via the website.

12. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the service after any changes constitutes acceptance of the updated terms. The most current version will always be available on this page.

13. Governing Law

These Terms of Service are governed by the laws of Japan. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Japan.
